




MIGHTY JETS and Nania F/C's argument that the Ghana Football Association (GFA's) Disciplinary Committee (DC) should be restrained from re-hearing their cases was last week quashed by the court.
Reports reaching DAILY GUIDE SPORTS indicated that both clubs had filed suits against the FA, following an Appeal Committee's decision on an earlier ruling that sent both clubs back to the FA's DC.
Mighty Jets, who were in court last Thursday, were told that their application was on a wrong premise and they were again fined¢30 million.
But Mr. Bode Olajeni, General Manager of Tudu Mighty Jets said the presiding judge had failed to deal with the substantial issue, “but because we are democrats, we respect the decision of the court even if we don't agree with it”, stressing that his club would not like to jeopardize the development of football in the country.
He emphasized, “If justice is not seen to be given to all parties involved in the case, then there are more obstacles in the running of the game.”
The Mighty Jets official complained that the judge, in giving the ruling, did not hammer on the merits of the case that was brought before him.
“He only commented and based his decision on the mode of submission of Mighty Jets' release, that they should have brought it in the form of an application instead of a writ.”
It would be recalled that on May this year, Mighty Jets claimed the case was already heard by the FA's DC, while the Appeals Committee set aside the entire proceedings.
They were therefore asked to go back to the same FA's DC due to some procedural errors.
However, Mr. Akwasi Afrifa, counsel for Nania /FC, after appearing before Justice Ofori-Attah who heard the application last Friday, said under the rules of civil procedure, it was Nania's turn to lodge an appeal, which formed the first step towards the finding of a process which would hold firm until the final determination of the appeal.
He said Nania F/C would today file the appeal, which would include putting an injunction on the Premier League.
“To justify the court case,” Mr. Afrifa said, “we were compelled to go to court because the FA's DC had heard the case already.
Witnesses were invited even when there were evidences before the Committee. The Committee itself substituted what it thought would be incriminating, because the Appeals Committee has no power to ask Nania to go back.
“If the FA could go by its calendar, then some cheating or injustice is being perpetrated, but Nania cannot determine when the league ought to be played.”
Meanwhile, Mr. Frank Davies, counsel for the GFA, has stated that nothing will prevent the FA from going ahead with its annually calendar.
“Filing an appeal does not mean they can stop the league from going on,” he said, adding that it was significant that after the ruling in court last Friday, there were seven days within which an appeal could be filed.
